BREATHLIFT: THE INWARD BREATH PLAN, REFUND POLICY

THIS REFUND POLICY (THE “REFUND POLICY”) FORMS AN INTEGRAL PART OF THE TERMS OF USE AND IT GOVERNS THE REFUND PROCESS OF YOUR PURCHASE (“PURCHASE”) OF OUR BREATHLIFT APP (INCLUDING, WITHOUT LIMITATION, ANY SUBSCRIPTIONS THERFOR OR ADD-ON ITEMS THERETO) (COLLECTIVELY, THE “PRODUCT”) VIA THE https://[TROCAR dominio]/ THE “WEBSITE”). NOTE, IF YOUR PURCHASE IS VIA AN APP STORE, YOUR PURCHASE IS SUBJECT TO THE APP STORE’S TERMS AND REFUND POLICY, AND THIS REFUND POLICY SHALL NOT APPLY TO THE PRODUCT TO THE EXTENT THIS REFUND POLICY CONFLICTS WITH THE APP STORE’S TERMS AND REFUND POLICY. THUS, YOU MUST CONTACT AN APP STORE’S SUPPORT TO REQUEST A REFUND WITH RESPECT TO ANY PURCHASE MADE THROUGH AN APP STORE.

1. General.

By using the Product, you confirm that you have read, understood and agreed to be bound by this Refund Policy and our Terms of Use.

Except as prohibited by law, we may change this Refund Policy at any time without notice, effective upon its posting on the Website if doing so does not unfairly disadvantage you and are necessary for development, security, or regulatory compliance, or to improve clarity. Your continued use of the Product shall be considered your acceptance of the revised Refund Policy. 

If we make material changes to this Policy, we will notify you of these changes with reasonable advance notice. 

Except as required by law and as otherwise stated in this Refund Policy, you agree that all Purchases, including subscription fees, are final and non-refundable and cannot be canceled or exchanged. Notwithstanding the foregoing, if a 30-day money-back guarantee was offered to you at the time of your initial purchase, you may be eligible for a refund within the first 30 days after your initial purchase.

Renewal charges are not eligible for a refund. For clarity, the full fee for any renewed subscription period (including, without limitation, any automatically renewed period following any length trial period) that has already started is non-refundable, regardless of how extensively you used or did not use the relevant Product. The only exception to this is where the fee falls within the scope of our money-back guarantee, in which case the money-back guarantee terms will apply instead.

For commitment subscription: if you are eligible for a refund under the 30-day money-back guarantee or similar offer and you were charged the early cancellation fee - we will refund both the initial purchase and the early cancellation fee.

In the event we decide to stop supporting or offering the Product as outlined in our Terms of Use, you acknowledge that no refunds (full or partial) will be issued for your lifetime subscription, except where a refund is strictly required by applicable consumer protection laws.

2. Process, Renewal Charges, Cancellation.

All refunds will be calculated according to the actual Purchase price paid at the time of Purchase, and will be made to the method provided for the Purchase. Please note that returns for credit and debit card transactions are issued within 2 (two) business days, however it may take up to 5 (five) business days for the credit to arrive at your credit card or bank account.

To request a refund or exchange, please contact Website customer service using the form. We reserve the right to refuse a refund request if it does not comply with this Refund Policy or if we determine, in our sole discretion, there has been an abuse of the Refund Policy.

In order to not be charged for a renewal, you must cancel your subscription or renewing add-on prior to the renewal date. When you cancel, your cancellation will be effective at the end of your then-current subscription period. No partial refunds shall be issued for cancellations made during any billing cycle or subscription period.

Uninstalling the app does not automatically cancel your subscription. To cancel your subscription, you must go to the app settings or https://app.[TROCAR dominio]/ and follow the prompts to cancel your subscription. 

For a commitment subscription: in case you want to cancel your commitment before the expiration of the commitment period - you will be charged a cancellation fee in the amount and on the terms agreed upon before the Purchase and your access to the Product will continue until the end of the paid for billing period.

3. Right of Withdrawal.

For residents of certain US states. If you reside in California or Connecticut and cancel the Purchase at any time prior to midnight of the 3rd (third) business day after the date of such Purchase, we will return the payment you have made.

For the European Union and UK residents. If you are based in the UK, EEA or Switzerland, you have the right to withdraw from the Product within fourteen (14) days from your purchase date without giving any reason, subject to the terms of this Refund Policy. This right of withdrawal expires fourteen days from the date of contract with us. 

To exercise your right of withdrawal, you must notify us of your decision to withdraw via:

  • Contacting Website customer service using the form;

  • Sending a letter to Editora Lar Ltda, Rua Waldemar Dantas, 100, Grageru, Aracaju - SE, 49025-300, Brazil, CNPJ 64.987.921/0001-72.

You may use the below form, but it is not required. It is sufficient that you send your withdrawal notice before the withdrawal period has expired.
